STUDENT SUCCESS PANEL ADMINISTRATIVE PROCEDURES

 

This document serves as the guiding procedures for the Student Success Panel.

 

Overview:

Pursuant to Orange Unified School District Board Policy 5131(a), students who violate District or school rules and regulations may be subject to discipline. Discipline includes, but is not limited to: suspension, expulsion, as well as other means of correction. As other means of correction, the District employees a variety of supports including transfer to alternate programs or schools, referral to a Student Success Panel, counseling services, denial of participation in extracurricular or co-curricular activities or other privileges, and site-based interventions.  Neither the Student Success Panel nor these procedures apply to an expulsion, which is subject to other policies and procedures.

The administrator responsible for determining and implementing disciplinary consequences to a student has the discretion to refer the student to a Student Success Panel Hearing for determination as to an appropriate means of correction.

A Student Success Panel consists of site administrators, administrative designees, and a District School Psychologist. The Student Success Panel shall not include individuals who participated in the underlying discipline, and all must be from schools that were uninvolved with the discipline.  The Student Success Panel will hear from the referring administrator, or his or her designee, who is responsible for presenting the school site’s information.  The Student Success Panel shall consist of three panel members.  Neither the referring administrator nor the school psychologist shall be involved in the process of deliberating or voting.  The purpose of the Student Success Panel is to determine what course of action will best address the needs of all students involved.

When determining the best course of action for the students involved, the Student Success Panel will consider the following:

●     The specific violation of California Education Code
●     Discipline and attendance history
●     Grade/current progress
●     Statements from school personnel, students, witnesses, and parents
●     Information presented during the Student Success Panel hearing and review process
●     Student interventions
●     Students’ educational needs (e.g., programmatic needs)

 

Panel Process:

The Student Success Panel meeting should take place expeditiously, with the expectation the hearing will occur before the expiration of the student suspension.  Prior to the Student Success Panel meeting, the student/ parent/guardian shall have the right to review the documents, materials, video and audio recordings, photographs and statements that the school site used in determining the student’s initial discipline and referral to the Student Success Panel and any documents being submitted by the school site to the Student Success Panel (collectively the “SSP Package.”)  The student/parent/guardian may request the opportunity to review the SSP Package at least one school day prior to the hearing.  If the administrator who recommended referral to the Student Success Panel, or his/her designee, intends to call live witnesses to the Student Success Panel, the student/parent/guardian will be advised of this fact at least one school day before the scheduled SSP hearing. 

The privacy of all students must be considered at all times, and the name and contact information of any other student included in a written statement will be redacted.  This shall not prevent a student who appears before the SSP from reviewing the totality of information regarding the disciplinary charges, even if some redactions of student identifiers are included.  The fact that another student may be a witness or present evidence does not entitle the review or inspection of that other student’s pupil records or contact information. 

At the time of the Student Success Panel hearing, the administrator who recommended referral to the Student Success Panel, or his/her designee, will present the SSP Package to the panel. The student being referred to the panel and the student’s parent/guardian shall have the right to provide all evidence, including documents, materials, and statements in defense of the student’s position.

After all evidence is presented, the Student Success Panel shall take the SSP Package and information submitted by the student/parent/guardian and determine what disciplinary measures are to be taken, if any, regarding the student within the parameters of the District Board Policy and California Education Code.  No participants in the hearing other than the SSP three panel members shall participate in the deliberation and determination.

The SSP decision shall be issued by the panel, in writing, within three school days of the panel hearing.  This decision will include an explanation of the basis of the SSP decision.    

During the SSP process, including the subsequent appeal periods, the student subject to discipline will be provided alternative means of educational instruction, whether by alternative enrollment or placement, an online option, or the student’s other choice of educational instruction.  The student will not be required to enroll at another school while the appeal process is pending, but will be expected to accept an educational option for instruction (whether online or otherwise) until the entire appeal process has concluded.

If at any time, the student/parent/guardian requests a foreign language translation or interpreter, OUSD shall provide that foreign language interpreter throughout their SSP Package review and hearing at the District’s expense. However, the student/parent/guardian can request their own translator/interpreter, at their own expense, who shall be granted access to the SSP Package and hearing under the same terms and conditions as the student/parent/guardian. 

 

Appeal

The student/parent/guardian has two levels of appeal after the SSP decision is rendered.

 

First Level Appeal:

If the student or the student’s parent/guardian disagrees with the decision of the Student Success Panel, they may submit an appeal.  The appeal shall be in writing and be provided to the Executive Director of Student & Community Services.  It must be submitted within five school days of receiving the Student Success Panel’s written decision.  In the appeal, the student/parent/guardian may explain why they believe the SSP decision was incorrect, whether the SSP package contained incorrect or incomplete information, whether the SSP failed to properly evaluate the evidence, and what information the SSP did not correctly weigh or consider.

The executive director of Student & Community Services, or his/her designee, will issue his/her review and determination on appeal in writing within five school days of receipt of the appeal request.  The appeal will involve a review of the SSP Package and information provided by the student/parent/guardian at the SSP hearing, and determine whether the Student Success Panel had substantial evidence to support its findings. 

 

Second Level Appeal:

If the student/parent/guardian do not agree with the decision on the first appeal, the student/parent/guardian shall have the right to pursue a second appeal to the Assistant Superintendent of Educational Services, or his/her designee.  The appeal must be submitted in writing and within five school days of the student/parent/guardian’s receipt of the Executive Director’s (or his/her designee) written decision as to the first level appeal.

In the second level of appeal, the Assistant Superintendent of Educational Services, or his/her designee will also review the SSP Package and information provided by the student/parent/guardian at the SSP hearing, and determine if there was substantial evidence to support the finding of the Student Success Panel and the first level of appeal determination.  The Assistant Superintendent of Educational Services, or his/her designee, shall issue a written decision on this issue within five school days of the receipt of the second level appeal.  The decision of that Assistant Superintendent of Educational Services, or his/her designee, is final administrative decision and there is no further administrative appeal after this second appeal.

The officials rendering decisions at the first level appeal and second level appeal shall not have been involved in the initial disciplinary decision, the decision to refer the student to the SSP, or the underlying SSP decision and shall not be from the referring school site.

Unlike an expulsion, there is no opportunity for a Board hearing or appeal to the County Office of Education.

Este documento sirve de guía para los procedimientos del Panel de Éxito Estudiantil.

Resumen:

De acuerdo con la Política del Consejo de Educación No.5131(a) del Distrito Escolar Unificado de Orange, los estudiantes que violen las normas y regulaciones del Distrito o de la escuela podrían estar sujetos a medidas disciplinarias. Dichas medidas incluyen, pero no están limitadas a: suspensión, expulsión, así como a otros medios de corrección. El Distrito emplea como otros medios de corrección, una variedad de apoyos incluyendo transferencia a programas alternativos, derivación a un Panel de Éxito Estudiantil, servicios de terapia sicológica, negación de participación en actividades extracurriculares dentro o fuera de la jornada escolar u otros privilegios, e intervenciones en la escuela.  Ni el Panel de Éxito Estudiantil, ni estos procedimientos, se aplican a una expulsión que está sujeta a otras políticas y procedimientos.

El admistrador responsable de determinar e implementar consecuencias disciplinarias para un estudiante tiene a su discreción remitir al estudiante a una audiencia con el Panel de Éxito Estudiantil para determinar un medio de corrección apropiado.

Un Panel de Éxito Estudiantil está compuesto por administradores escolares, personal administrativo designado y un sicólogo educativo del distrito.  El Panel de Éxito Estudiantil no debe incluir individuos que participaron en disciplinar al estudiante, y todos deben pertenecer a escuelas que no estuvieron involucradas en la disciplina.  El Panel de Éxito Estudiantil escuchará al administrador remitente, o a su designado, quien será responsable de presentar al panel la información de su escuela. El Panel de Éxito Estudiantil consistirá de tres miembros.  Ni el administrador remitente, ni el psicólogo educativo, participarán en el proceso de deliberación o votación.  El propósito del Panel de Éxito Estudiantil es determinar qué curso de acción responderá mejor a las necesidades de los estudiantes involucrados.

Al determinar el mejor curso de acción para los estudiantes involucrados, el Panel de Éxito Estudiantil tendrá en cuenta lo siguiente:

●     La violación del Código de Educación de California
●     Historial de disciplina y asistencia a clase
●     Calificaciones y progreso actual
●     Declaraciones del personal de la escuela, estudiantes, testigos y padres
●     Información presentada durante la audiencia del Panel de Éxito Estudiantil y repaso del proceso
●     Intervenciones para el estudiante
●     Necesidades de aprendizaje del estudiante (p.ej.: necesidades relativas al programa)

 

Proceso del Panel:

La reunión con el Panel de Éxito Estudiantil debe realizarse sin demora, con la expectativa de que la audiencia se lleve a cabo antes de que caduque la expulsión del estudiante. Previo a la reunión con el Panel de Éxito Estudiantil, el estudiante y/o el padre o tutor tendrán derecho a revisar los documentos, materiales, grabaciones de video y audio, folografías y declaraciones que la escuela usó para determinar la disciplina inicial y remisión al Panel de Éxito Estudiantil, y cualquier otro documento que esté siendo presentado por la escuela al Panel de Éxito Estudiantil (todo esto en conjunto se denomina “paquete o expediente del SSP”). El estudiante, el padre, o el tutor, pueden solicitar la oportunidad de repasar el paquete del SSP, con por lo menos un día de anticipación a la audiencia. Si el administrador que recomendó la remisión al Panel de Éxito Estudiantil, o su designado(a), tiene planeado llamar a testigos en persona para declarar en la audiencia del Panel de Éxito Estudiantil, se debe informar este hecho al estudiante, el padre, o tutor, con por lo menos un día de anticipación a la audiencia programada del SSP.  

La privacidad de los estudiantes debe considerarse en todo momento, y el nombre e información de contacto de cualquier otro estudiante incluídos en una declaración escrita serán eliminados.  Esto no debe impedir que el estudiante que se presenta a la audiencia con el panel SSP revise la totalidad de la información con respecto a los cargos disciplinarios, aún cuando se hayan eliminado algunos nombres o identificadores de estudiantes.  El hecho de que otro estudiante sea testigo, o presente evidencia, no lo autoriza a repasar o inspeccionar el expediente de otro alumno, o su información de contacto.

En el momento de la audiencia del Panel de Éxito Estudiantil, el administrador que recomendó la remisión al Panel de Éxito Estudiantil, o su designado, presentará el paquete del SSP al panel. Tanto el estudiante remitido al panel, como el padre o tutor del estudiante deberán tener derecho a presentar toda evidencia, incluyendo documentos, materiales y declaraciones en defensa de la posición del estudiante.

Después de haberse presentado toda la evidencia, el Panel de Éxito Estudiantil usará la información del paquete del SSP y la información presentada por el estudiante, padre, o tutor y determinará qué medidas disciplinarias se deben tomar, si las hay, con respecto al estudiante, dentro de los parámetros de la Política del Consejo de Educación del Distrito y el Código de Educación de California.  Ningún participante de  la audiencia aparte de los tres miembros del panel SSP tendrá parte en la deliberación y decisión.

El panel SSP emitirá su decisión por escrito, dentro de los tres días escolares siguientes a la audiencia del panel.  Esta decisión incluirá una explicación de los fundamentos de dicha decisión del SSP.   

Durante el proceso de SSP, incluidos los períodos de apelación siguientes, al estudiante sujeto a disciplina se le brindarán medios alternativos de instrucción académica, ya sea mediante inscripción o colocación en un programa alternativo, una opción en línea o una otra opción de instrucción académica que elija el estudiante.  No se exigirá al estudiante que se matricule en otra escuela mientras esté pendiente el proceso de apelación, pero se esperará que acepte una opción educativa para la instrucción (ya sea en línea o de otro tipo) hasta que haya concluido todo el proceso de apelación.

Si en algún momento, el estudiante, padre, o tutor, solicita un intérprete o traductor de idioma extranjero, el Distrito OUSD proporcionará dicho intérprete de idioma extranjero durante la revisión de su paquete del SSP y la audiencia a expensas del Distrito. Sin embargo, el estudiante, padre, o tutor puede solicitar su propio traductor o intérprete, a su propio costo, a quien se le otorgará acceso al paquete del SSP y a la audiencia bajo los mismos términos y condiciones que al estudiante, padre o tutor. 

 

Apelación

Después de que el panel SSP haya tomado su decision, el estudiante, o el padre o tutor, dispondrá de dos niveles de apelación.

 

Primer nivel de apelación:

Si el estudiante, o el padre o tutor del estudiante, no está de acuerdo con la decisión del Panel de Éxito Estudiantil, puede presentar una apelación.  Dicha apelación debe presentarse por escrito y ser entregada al Director Ejecutivo de Servicios Estudiantiles y Comunitarios.  Deberá presentarse dentro de los cinco días lectivos siguientes de haber recibido la decisión escrita del Panel de Éxito Estudiantil.  En la apelación, el estudiante, padre o tutor, puede explicar por qué cree que la decisión del Panel de Éxito Estudiantil fue incorrecta, si el paquete del Panel de Éxito Estudiantil contenía información incorrecta o incompleta, si el Panel de Éxito Estudiantil no evaluó correctamente las pruebas y qué información no examinó o consideró correctamente el Panel de Éxito Estudiantil.

El Director Ejecutivo de Servicios Estudiantiles y Comunitarios, o la persona que éste designe, emitirá su revisión y decisión sobre la apelación por escrito en un plazo de cinco días lectivos a partir de haber recibido la solicitud de apelación.  La apelación implicará una revisión del paquete del SSP y de la información proporcionada por el alumno, padre o tutor, en la audiencia del SSP, y determinará si el Panel de Éxito Estudiantil tenía pruebas sólidas para apoyar sus conclusiones. 

 

Segundo nivel de apelación:

Si el estudiante, padre o tutor, no está de acuerdo con la decisión de la primera apelación, el estudiante, padre o tutor, tendrá derecho a presentar una segunda apelación ante el Asistente del Superintendente de Servicios Educativos, o la persona que éste designe.  La apelación deberá presentarse por escrito y en un plazo de cinco días lectivos a partir de la fecha en que el estudiante, padre o tutor, reciba la notificación escrita de la decisión del Director Ejecutivo, o su designado, de la primera apelación.

En el segundo nivel de apelación, el Asistente del Superintendente de Servicios Educativos, o su designado, también revisará el expediente del panel SSP y la información proporcionada por el estudiante, padre o tutor en la audiencia SSP, y determinará si hubo evidencia sustancial para apoyar la conclusión del Panel de Éxito Estudiantil y la decisión del primer nivel de apelación.  El Asistente del Superintendente de Servicios Educativos, o su designado, emitirá una decisión por escrito sobre este asunto dentro de los cinco días escolares siguientes a la recepción de la apelación de segundo nivel.  La decisión del  Asistente del  Superintendente de Servicios Educativos, o su designado, es la decisión administrativa final y no hay más apelaciones administrativas después de esta segunda apelación.

Los funcionarios que tomen las decisiones en la apelación de primer nivel y en la apelación de segundo nivel no podrán haber participado en la decisión disciplinaria inicial, ni en la decisión de remitir al alumno al SSP, ni en la decisión previa del SSP, y no podrán ser de la escuela remitente.

A diferencia de una expulsión, no existe la oportunidad de tener una audiencia con el Consejo de Educación, ni de apelar a la Oficina de Educación del Condado.
